What does Probate mean? In the simplest terms, Probate is a process that verifies if a Will is real.
Does everyone have to apply for Probate? Not exactly, no. Whether a will needs to be probated or not depends on the institution that is holding the asset. Some institutions may require that a will be probated BEFORE they allow access or distribute the funds to any parties.
What does this mean, and does it apply to you?
Let’s say your father had all of his money in one bank account, and he left it all to you. This financial institution may require you to prove that the Will is legitimate before you are able to access the funds, or distribute them to anyone, or yourself. Again, depending on the bank, the may require you to receive what’s called a “Grant of Probate”, which is what is granted once you have successfully applied for probate.
The process of probating a will is not as straight-forward as most people think. There are a lot of things to consider and various forms that are required to be filed in Court.
